Terms of Service

1. Acceptance of Terms

By downloading, installing, or using any application developed by Cozy River Studios ("we," "our," or "us"), including Calm Brush: Kanji and future apps (collectively, "our Services" or "Apps"), across any platform including but not limited to Apple App Store, Google Play Store, Steam, and other distribution platforms, you agree to be bound by these Terms of Service and End User License Agreement ("Terms" and "EULA"). If you do not agree to these Terms, do not use our Services.

These Terms constitute a legally binding agreement between you and Cozy River Studios. We reserve the right to modify these Terms at any time. Continued use of our Services after changes constitutes acceptance of the modified Terms.

2. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install our Apps on devices you own or control
• Use our Apps for personal, non-commercial purposes
• Access content and features according to your subscription level

This license is subject to the respective platform's terms: Apple's Licensed Application End User License Agreement for App Store, Google Play Terms of Service for Android, and Steam Subscriber Agreement for Steam.

3. In-App Purchases and Subscriptions

3.1 Purchase Terms

• In-app purchases are processed through the respective platform store (Apple, Google, Steam)
• Prices are displayed in your local currency before purchase
• All purchases are final and non-refundable except as required by law or platform policy
• You are responsible for all charges incurred through your account
• Cross-platform purchases may not transfer between stores

3.2 Premium Features

Premium purchases may include:

• Additional brush styles and customization options
• Advanced kanji sets and learning modules
• Unlimited practice sessions
• Progress synchronization across devices
• Early access to new language packs
• Ad-free experience (if applicable)

3.3 Subscriptions

If we offer subscription services:

• Subscriptions automatically renew unless cancelled 24 hours before the renewal date
• Subscription prices may vary by region and duration
• Free trials convert to paid subscriptions unless cancelled
• Manage subscriptions through your App Store account settings
• No partial refunds for unused subscription periods

3.4 Restoration of Purchases

Previously purchased content can be restored on any device using the same platform account (Apple ID, Google Account, Steam Account). Use the "Restore Purchases" option in the app settings if your purchases are not automatically recognized. Purchases are tied to the platform where they were made.

3.5 Platform-Specific Refund Policies

• Apple App Store: Refunds handled through Apple's refund request system
• Google Play Store: 48-hour refund window for most purchases per Google policy
• Steam: 14-day refund window with less than 2 hours of playtime per Steam policy
• We cannot directly process refunds; all refunds must go through the platform store

4. User Accounts and Data

4.1 Account Responsibility

• You are responsible for maintaining account security
• You must provide accurate information
• You are responsible for all activities under your account
• Notify us immediately of unauthorized access

4.2 User Content

For any content you create using our Apps (drawings, practice sessions, notes):

• You retain ownership of your created content
• You grant us a license to store and display your content within the app
• You are responsible for backing up your local data
• We are not liable for loss of user-generated content

5. Acceptable Use Policy

You agree not to:

• Use our Services for any illegal or unauthorized purpose
• Reverse engineer, decompile, or disassemble our Apps
• Copy, modify, or distribute our Apps or content
• Use our Services to harm, threaten, or harass others
• Interfere with or disrupt our Services or servers
• Attempt to gain unauthorized access to our systems
• Use automated systems to access our Services
• Resell or commercially exploit our Services
• Violate any applicable laws or regulations

6. Intellectual Property Rights

6.1 Our Property

All content in our Apps, including but not limited to:

• Software code and architecture
• Designs, graphics, and user interfaces
• Kanji stroke data and learning algorithms
• Audio and visual content
• Trademarks and logos
• Documentation and tutorials

Are owned by or licensed to Cozy River Studios and protected by intellectual property laws.

6.2 Feedback

Any feedback, suggestions, or ideas you provide become our property and may be used without compensation or attribution to improve our Services.

7. Disclaimers and Limitations

7.1 No Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

• MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION
• RESULTS FROM USE OF OUR SERVICES

7.2 Educational Purpose

Our Apps are designed for educational and entertainment purposes. We do not guarantee specific learning outcomes or proficiency levels. Individual results may vary based on practice and dedication.

7.3 Third-Party Services

We are not responsible for third-party services, including the Apple App Store, payment processors, or cloud storage providers. Their terms and policies apply to their respective services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COZY RIVER STUDIOS SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF PROFITS, DATA, OR USE
• INTERRUPTION OF BUSINESS
• DAMAGES EXCEEDING THE AMOUNT YOU PAID FOR OUR SERVICES IN THE PAST 12 MONTHS

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless Cozy River Studios, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws

10. Termination

We reserve the right to:

• Terminate or suspend your access at any time, with or without cause
• Remove or disable access to content that violates these Terms
• Discontinue our Services at any time

Upon termination, your license to use our Services ends immediately. Provisions that should survive termination (including intellectual property, disclaimers, and limitations) remain in effect.

11. Governing Law and Disputes

11.1 Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

11.2 Dispute Resolution

Any disputes arising from these Terms or our Services shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive the right to participate in class actions or class arbitrations.

11.3 Exceptions

Either party may seek injunctive relief in court for intellectual property violations or breach of confidentiality.

12. General Provisions

12.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Cozy River Studios.

12.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full effect.

12.3 Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

12.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

13. Platform-Specific Terms

13.1 Apple App Store

• These Terms are between you and Cozy River Studios, not Apple
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for product claims or liabilities
• Apple is a third-party beneficiary with the right to enforce these Terms
• You must comply with Apple's terms and conditions

13.2 Google Play Store

• You must comply with Google Play Terms of Service
• Google is not responsible for app support or liability
• Purchases are subject to Google's payment terms
• Family Library sharing subject to Google's policies

13.3 Steam

• You must comply with Steam Subscriber Agreement
• VAC (Valve Anti-Cheat) policies apply where applicable
• Steam Workshop content subject to additional terms
• Steam Cloud saves subject to Valve's data policies

14. End User License Agreement (EULA)

14.1 Grant of License

Cozy River Studios grants you a personal, non-exclusive, non-transferable, revocable license to use our software applications solely for personal, non-commercial purposes on devices you own or control.

14.2 License Restrictions

You may not:

• Distribute, sell, lease, rent, or sublicense the software
• Modify, adapt, translate, or create derivative works
• Reverse engineer, decompile, or disassemble the software
• Remove any proprietary notices or labels
• Use the software for commercial purposes without written permission
• Share your account or license with others

14.3 Ownership

The software is licensed, not sold. Cozy River Studios retains all right, title, and interest in and to the software, including all intellectual property rights. Your license confers no title or ownership and is not a sale of any rights.

14.4 Updates and Modifications

We may provide updates, patches, or new versions at our discretion. Such updates may be required for continued use. We may modify or discontinue features without liability to you.

14.5 Termination of License

Your license automatically terminates if you violate these terms. Upon termination, you must cease all use and destroy all copies of the software. Sections regarding ownership, disclaimers, and limitations of liability survive termination.

15. Content Guidelines and Age Rating

Our apps are designed to be appropriate for all ages:

• No violent or graphic content
• No inappropriate language or themes
• Educational and family-friendly focus
• Rated E for Everyone (ESRB) / PEGI 3 / G (General Audiences)
• No online interactions with strangers
• No gambling or simulated gambling
